PRIVACY STATEMENT IN CONFORMANCE WITH ART. 13 OF LAW DECREE n. 196 dated 30/06/2003 (Italian Legislation) For the purpose of art. 13, Law Decree 196 dated 30/06/2003 (concerning the safeguarding of confidentiality and privacy), BIO COM, having its legal office at Opera (MI) Via Papa Giovanni XIII, 3 and its head office at Settimo Milanese (MI) Via Darwin, 2, is responsible for providing you with all the relevant information concerning the use of any personal data you may openly send us through the card or otherwise collected by BIO COM, always in the sphere of our activity. 1 Method for personal data collection. Personal data is collected by BIO COM S.r.l. in the following ways: 1.1 Collection by electronic means 1.2 Collection by the individual concerned 1.3 Collection by cards and quotation requests 1.4 Consultation of registers, lists, acts or public documents 1.5 Collection by specialist trade directories 2 Data processing method. Data will be processed to safeguard the safety and the personal privacy and it will be stored by our head office at Settimo Milanese (MI) Via Darwin, 2 and handled purely for company business. Data will be handled in the following ways: 2.1 Recorded and processed on hard copy 2.2 Compilation of automated profiles of the individual concerned with a possible classification according to company size, business sector, geographical location 3 Data processing purpose. This data will be processed with the following aims in mind: 3.1 Promotional activity, direct quotations for goods and services by post mail, by telephone and e-mail 3.2 Information on new products and services launches 3.3 Marketing activity (promotional material, leaflets and reference list) 3.4 Customer satisfaction survey and market surveys 3.5 Precontractual information and documents relevant to specific contracts (contracts management, orders, invoices, expediting) 3.6 Fulfilment of tax and financial obligations 4 Communication and circulating of data. In accordance with the company's activities, data of the individual concerned may be passed on to outside parties, such as: 4.1 Public bodies 4.2 Organizations that supply bank and financial consultancy 4.3 Consultants and independent professionals, also acting as partners 4.4 Outside companies specializing in printing, transmission and expediting 4.5 Companies that supply information about the financial risk of a company 4.6 Companies that supply hardware maintenance service With reference to point 4.1, consent is not needed since the processing concerns data collected and kept in compliance with an obligation imposed by Law, Regulations and Community legislation. Regarding point 4.2, data communication to banking or financial organizations can happen: - If the individual concerned to provides the data in relation to specific operations (ex.: gathering of the bank details for a bank transfer by the individual concerned); - Due to a decision of our company (ex.: invoice copies sent to the bank for a credit application). In this second case the specific consent of the person concerned is required Regarding data processing as per points 4.3, 4.4, 4.5 and 4.6, data handling by the above mentioned subjects will be done acting as "external third party"; but our company remains the Holder of data processing. In this case, data sent to these subjects and the relevant processing can be lawfully carried out also without the consents of the person concerned. A copy of the External Responsible List is available at our premises. 5 Obligatory or optional nature of data transfer 5.1 Data transfer as per point 3.1 is optional. If you would prefer not to receive any promotional material or quotations for goods and services, please inform in writing the Responsible person, who is domiciled by our company. If written notification is not received from the individual concerned, our company will continue to send advertising material and offer its goods and services by post, e-mail, fax and telephone. 5.2 Data transfer as per points 3.2, 3.3, and 3.4 is optional. You are entitled to give or refuse your consent, referring to the above mentioned methods. Should you deny authorization, it will not be possible to pursue the purposes as listed above. 5.3 The provision of data in relation to points 3.5 and 3.6 is strictly necessary to create and solidify the commercial relationship. Should you deny authorization, it will not be possible to establish and continue the relationship. 6. Responsible of the treatment. The person Responsible for the personal data transfer within the company is Dott. Ing. Sergio Mauri, acting in his capacity as Legal Representative of BIO COM's company and reachable at this company. 7. Rights as per art. 7 of Law Decree 196. Please also note that, in conformance with art. 7 of Law Decree 196, those, who are concerned and supply personal information for processing have the right to : - obtain by the Owner or by the Responsible, the confirmation or otherwise of the existence of personal information; - receive this information in an intelligible form, with details about how it was obtained and how and for what purposes it is being processed; - ask for the removal, conversion into anonymous form, or veto on use; - ask for the existing data to be updated or amended and, whenever necessary, the addition of new data to the entry; - object for legitimate reasons to the processing of personal information.
